LuckVM Cloud Service Platform User Terms of Service

Article 1: Scope of Services

• 1.1 Service Offerings: LuckVM provides you with the rental and hosting of Cloud Servers (VPS), Bare Metal Servers, GPU Servers, and Dedicated Hosts deployed in various countries and regions including but not limited to Hong Kong, the United States, Japan, South Korea, Singapore, Malaysia, and Taiwan. We also provide global domain registration, DNS resolution, and related IT infrastructure value-added services.
• 1.2 Dynamic Adjustments: LuckVM reserves the right to modify, upgrade, add, or discontinue specific services at any time based on market conditions and technological developments.

Article 2: Account Registration, Use, and Security

• 2.1 Eligibility: You must have the full legal capacity to enter into a binding contract under applicable laws.
• 2.2 Authentic Information and KYC: You must provide true, accurate, and complete registration information. Depending on the laws of the data center's location or domain registry policies, you may be required to complete Identity Verification (KYC). LuckVM reserves the right to suspend your account and terminate services if you provide false information.
• 2.3 Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and API keys. You are fully responsible for all activities that occur under your account. LuckVM strictly prohibits renting, lending, transferring, or selling your account to any third party.

Article 3: Acceptable Use Policy (AUP)

• 3.1 Illegal and Infringing Content: Strictly prohibited from using our servers to store, publish, or transmit any content related to child pornography, terrorism, violence, pyramid schemes, gambling, or illegal drugs. Infringement of intellectual property rights (such as copyright, trademarks, or patents, e.g., hosting pirated movie/software sites) is strictly forbidden.
• 3.2 Network Abuse and Attacks:
  
  
  • No form of network attacks (including DDoS, CC, UDP flooding, etc.).
  • No unauthorized port scanning, vulnerability probing, or password brute-forcing.
  • No sending of spam, phishing emails, or engaging in fraudulent activities.
  • No hosting of Command and Control (C&C) nodes for botnets.
• 3.3 Resource Abuse: For shared cloud servers (VPS), users are prohibited from continuously consuming excessive CPU, disk I/O, or public bandwidth resources that disrupt other tenants on the same host node. Unauthorized cryptocurrency mining is strictly prohibited on all non-dedicated servers.
• 3.4 Illegal Proxies: It is strictly prohibited to use LuckVM's global network nodes to build network proxies, bypass tools, or VPNs that violate local laws or are used for illegal cross-border data transmission.

Article 4: Orders, Billing, and Refund Policy

• 4.1 Pre-paid Model: LuckVM operates on a pre-paid basis ("pay first, use later"). You must ensure sufficient account balance or pay your invoices promptly.
• 4.2 Renewals and Suspensions: You must renew your services before the expiration date. Upon expiration, the system will automatically suspend your instance. If the service remains unpaid for more than 3 days after expiration, the system will automatically terminate/destroy the server and all underlying data. Data cannot be recovered.
• 4.3 Strict Refund Policy:
  
  
  • Bare Metal / Dedicated Hosts / GPU Servers: Due to hardware procurement and deployment labor costs, no refunds will be provided once provisioned, regardless of the reason.
  • Domain Registration: Once a domain is successfully registered with the registry, it incurs irreversible costs. Domain registrations are strictly non-refundable.
  • AUP Violations: No refunds will be issued for services suspended or terminated due to violations of Article 3 (AUP), and LuckVM reserves the right to seek compensation for any resulting damages.

Article 5: Domain Registration Specific Terms

• 5.1 Compliance with Rules: By registering a domain, you agree to be bound by the policies of ICANN (Internet Corporation for Assigned Names and Numbers) and the respective Top-Level Domain (TLD) registries (e.g., Verisign).
• 5.2 Naming and Disputes: You guarantee that the registered domain name does not infringe upon the legitimate rights of any third party. If a domain triggers a Uniform Domain-Name Dispute-Resolution Policy (UDRP) arbitration or lawsuit, you shall bear all consequences. LuckVM will only provide necessary cooperation and assumes no joint liability.

Article 6: Data Security and User Backup Responsibility

• 6.1 Absolute Backup Responsibility: You understand and agree that you bear the ultimate responsibility for backing up all business data stored on LuckVM's cloud and bare metal servers. We strongly recommend regularly backing up your critical data using snapshots or off-site backups.
• 6.2 Disclaimer for Data Loss: Although LuckVM's infrastructure is designed for high availability, LuckVM shall not be liable for any direct or indirect damages resulting from data loss or corruption caused by physical hardware failure, RAID crashes, force majeure, hacker attacks, or your own operational errors.
• 6.3 Privacy Protection: LuckVM respects and protects your privacy. We will never unauthorizedly access your internal server business data.

Article 7: Intellectual Property

• 7.1 LuckVM's IP: All intellectual property rights related to the LuckVM platform, website design, source code, logos, and trademarks belong exclusively to our company.
• 7.2 User's IP: The intellectual property of the website code, databases, and software applications hosted on LuckVM servers belongs to you or the original rights holders. You must ensure you have the legal right to use such content.

Article 8: Limitation of Liability and Force Majeure

• 8.1 Liability Cap: To the maximum extent permitted by applicable law, regardless of the cause (including breach of contract, tort, etc.), LuckVM's total cumulative liability to you for any damages shall not exceed the actual fees paid by you to LuckVM for the affected service during the one (1) billing cycle immediately preceding the event giving rise to the claim. LuckVM strictly disclaims any liability for indirect, incidental, special, or consequential damages, including but not limited to loss of profits or loss of goodwill.
• 8.2 Force Majeure and Third-Party Exemptions: LuckVM is exempt from liability for service unavailability or access delays caused by force majeure events such as typhoons, earthquakes, tsunamis, natural disasters, wars, riots, government censorship, international submarine cable interruptions, or backbone network failures of telecommunications operators.

Article 9: Modification and Termination

• 9.1 Modification of Terms: LuckVM reserves the right to modify this Agreement at any time. The updated version will be published on our official website. If you disagree with the changes, you have the right to stop using the services. Your continued use constitutes acceptance of the modified terms.
• 9.2 Termination for Breach: If you materially breach this Agreement (especially the AUP), LuckVM reserves the right to unilaterally terminate this Agreement at any time, immediately suspend services, and permanently delete your data without issuing any refunds.

Article 10: Governing Law and Dispute Resolution

• 10.1 Governing Law: The establishment, validity, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.
• 10.2 Jurisdiction: Any disputes arising from or relating to this Agreement or LuckVM services shall be settled through friendly negotiation. If negotiation fails, either party has the right to submit the dispute to the competent courts of the Hong Kong Special Administrative Region for adjudication.
